It is often a challenge to convince a cost-conscious client that spending what will be a comparatively small amount of time and money collecting ESI right from the outset. Remediation of a substandard collection later in the life of your case, perhaps later during discovery or as a case approaches trial, is always more resource intensive and much more expensive. Also, the opportunity to exploit potential evidence for your case may be lost when shortcuts are taken.
With all the tools, discussion and competing interests in the collection ESI for discovery in litigation, this may seem like a time where a client can save money by taking shortcuts. Experience tells us that there are ways to control costs while still preserving the right data and while maintaining the integrity of the data. You must be armed to effectively deal with evidence issues that invariably arise as a litigation matter matures.
